These Terms of Use govern access to and use of the Montage app, the Montage Pro app and the website montageapp.com.br (together, the “Platform”), operated by Montage (a company in the process of incorporation in Brazil) (“Montage”, “we”).
Montage is a technology platform that connects travelers with licensed tour guides in the city of Rio de Janeiro, allowing private experiences to be booked by the hour. By creating an account, accessing or using the Platform, you declare that you have read, understood and agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Platform. Use of the Platform is permitted only to persons over 18 years of age with full legal capacity.
Montage is a technology platform that intermediates the connection between travelers and licensed, self-employed tour guides. Guides are independent professionals with an active Cadastur registration and have no employment, corporate or agency relationship with Montage. The contract for the provision of the tourism service is entered into directly between the traveler and the guide; Montage acts exclusively as an intermediary and payment processor.
To book or offer experiences you must create an account with true, complete and up-to-date information. You are responsible for keeping your credentials confidential and for all activity carried out with your account, and must immediately notify Montage of any unauthorized use. Montage may refuse, suspend or terminate accounts that violate these Terms, provide false information or pose a risk to the security of the Platform and its users.
Only guides with an active registration in Cadastur (Brazilian Ministry of Tourism) may offer services on the platform. Montage may verify the registration at any time and suspend accounts with inactive or irregular registration. Guides are responsible for keeping their registration details, languages, specialties, hourly rate and availability up to date, and for complying with the legislation applicable to the tour guide activity.
The address provided by the traveler in the booking corresponds exclusively to the meeting point with the guide, which must be located within the municipality of Rio de Janeiro — it may be, for example, the traveler’s place of accommodation. The tour itinerary is defined by mutual agreement between the traveler and the guide. A booking is confirmed after payment approval and acceptance by the guide, according to the rules displayed in the app. Traveler and guide must be at the meeting point on the booked date and time; delays and changes must be communicated through the app.
The price is set by the guide (hourly rate multiplied by the booked duration) and paid in advance through the platform, via a partner payment processor. Currently, Montage charges guides an intermediation commission on completed bookings and does not charge travelers a service fee; Montage reserves the right to introduce or change service fees, for either party, upon prior notice on the platform. Tour expenses — such as tickets, transportation and meals — are not included in the booking amount and are settled directly between the traveler and the guide.
Cancellations and refunds follow the policy in force displayed at the time of booking, within the app. If the guide cancels or fails to show up at the meeting point, the traveler will be fully refunded for the amount paid on the Platform. Refunds are processed through the same payment method used, within the payment processor’s timeframes.
When using the Platform, you agree to: (a) provide true information; (b) treat guides, travelers and the Montage team with respect; (c) comply with applicable law, including tourism, traffic and environmental and heritage protection rules; (d) not use the Platform for unlawful or fraudulent purposes or in violation of third-party rights. The following conduct, among others, is prohibited: requesting, offering or accepting payment outside the platform for bookings initiated through it, which may result in suspension or termination of the account; using third-party accounts or creating multiple accounts to circumvent restrictions; posting offensive, discriminatory or false content; and attempting to improperly access, copy or interfere with the Platform’s systems.
After the experience, travelers and guides may review each other. Reviews must be truthful, respectful and based on the experience that took place. Montage may remove reviews that violate these Terms, contain insults, third-party personal data or signs of fraud, but is not responsible for the opinions expressed by users.
Tourism services are provided by the guides, who are solely responsible for their performance. Nothing in these terms waives rights guaranteed by Brazilian law, including the Consumer Protection Code. Montage does not guarantee uninterrupted availability of the Platform and is not liable for failures caused by third parties, unforeseeable circumstances, force majeure or misuse. To the extent permitted by applicable law, Montage’s liability for damages related to a booking is limited to the intermediation commission received for that booking.
The Montage brand, the apps, the website, their layouts, texts, code, databases and other content are owned by Montage or its licensors and are protected by intellectual property law. Users are granted a limited, non-exclusive and revocable license for personal use of the Platform. Content submitted by users (such as profile photos and reviews) remains their property, but users authorize Montage to display it on the Platform and in materials promoting the service.
Montage may change these Terms at any time. Relevant changes will be communicated through the Platform or by e-mail with reasonable notice, and the updated version will indicate its effective date. Continued use of the Platform after the changes take effect constitutes acceptance of the new Terms.
These terms are governed by the laws of the Federative Republic of Brazil, with jurisdiction in the courts of the city of Rio de Janeiro/RJ. Questions about these Terms may be sent to contato@montageapp.com.br.
