MONTAGE (“Montage”, “Montage Pro”, “Montage App”), a limited liability company, is a legal entity governed by private law providing online advertising services, carried out between promising Clients (“Client”) and promising Professionals (“Professionals”). ”), through the Montage application and website (“Platform”).
Before using the Platform, take the time to read our Terms of Use and learn about the rules that guide our relationship. By registering and using MONTAGE, these Terms constitute our agreement with you. Below we present some useful concepts to facilitate the understanding of these Terms of Use:
MONTAGE
PLATFORM: System consisting of a mobile application (iOS and Android), offered by MONTAGE, which allows USERS to publicize, view, make available and contract services offered through the PLATFORM.
CHARGEBACK: Procedure in which a buyer disputes a payment transaction with the bank that issued the card.
USERS: Customers and Professionals registered on the PLATFORM.
CUSTOMER: Individual or legal entity registered on the PLATFORM, who accesses and/or uses the services offered by PROFESSIONALS on the PLATFORM.
PROFESSIONAL: Individual or legal entity registered on the PLATFORM that, when using it, offers its services to CLIENTS, independently and autonomously.
2.1. MONTAGE is an online PLATFORM that brings together CLIENTS who need maintenance and renovation services and PROFESSIONALS who offer their services independently and autonomously.
2.2. MONTAGE does not interfere in negotiations between USERS, and it is up to them to agree on service conditions, such as time, price, quality, deadline and other relevant points.
3.1. When registering on the PLATFORM, the USER, whether CUSTOMER or PROFESSIONAL, agrees to observe the conditions of use described in this term, the applicable legislation in force and the processing of personal data by MONTAGE, governed by the Privacy Policy that is part of this Term.
3.2. The USER may not create more than one account on the PLATFORM, which is intended exclusively for adults. In case of multiple registrations or use by children or teenagers, the account will be deleted, without prior notice, and MONTAGE may not accept new registrations.
3.3. USERS are responsible for all actions carried out on the PLATFORM and must protect their access data. MONTAGE is not responsible for any damage caused by failure to comply with this obligation.
3.4. USERS are responsible for keeping their registration information up to date and true, especially payment information, and must inform MONTAGE of any changes. MONTAGE is not responsible for any problems resulting from incorrect information provided by USERS.
3.5. MONTAGE may request additional information and documents, such as a Criminal Record Certificate, and use all valid means to verify the identity of its users and the veracity of the information provided.
3.6. If a USER’s registration contains incorrect or false data, MONTAGE may suspend or permanently exclude the USER, without prior notice or compensation.
3.7. The USER must immediately inform MONTAGE of any irregularities by other USERS that could cause damage to USERS, MONTAGE or third parties. If MONTAGE becomes aware that any USER is breaking the law, their account will be deleted immediately, without prior notice, and MONTAGE may reject new registration.
3.8. MONTAGE reserves the right to, unilaterally, without prior notice, consent or compensation, refuse any request for registration from a USER on the PLATFORM, when it has justified reasons to believe that the USER may be violating the law, or even, when it can place assets and rights of MONTAGE and its other USERS are at risk.
3.9. Under no circumstances will the assignment, sale, rental or other form of transfer of the USER’s account be permitted.
4.1. DOCUMENTATION
4.1.1. In addition to the rules applicable to all USERS, the PROFESSIONAL must provide documents (“Documentation”) that prove their identity and, depending on the FUNCTIONALITIES desired, their technical and professional qualifications.
4.1.2. Whenever MONTAGE deems it necessary,
